Emission Trading: allocazione di quote gratuite da ricalcolare

Il 28 aprile 2016 la Corte di giustizia europea ha dichiarato non valido il quantitativo annuo massimo di quote a titolo gratuito per le emissioni di gas serra, stabilito dalla CE per il periodo 2013-2020.

La Corte di giustizia è stata interpellata a seguito delle azioni legali che diverse società coinvolte nel sistema ETS hanno intrapreso in Italia, Olanda e Austria contro le autorità nazionali competenti. L’oggetto della controversia è il metodo di calcolo applicato per definire il numero massimo di quote.

La sentenza stabilisce che il fattore di correzione inter-settoriale (CSCF) applicato alle allocazioni preliminari con Decisione 2013/448/UE non è valido e deve essere ricalcolato sulla base dei nuovi dati che verranno forniti dagli Stati membri; il quantitativo di quote a titolo gratuito potrebbe risultare superiore ma anche inferiore a quello oggi vigente.

Gli effetti della sentenza entreranno in vigore solo tra 10 mesi, termine entro il quale la Commissione dovrà aver effettuato il ricalcolo. Le precedenti allocazioni di quote, ad ogni modo, non potranno subire variazioni.

The judgment is a consequence of the legal actions that a number of companies included in the scope of ETS brought before the courts in Italy, the Netherlands and Austria against the National Authorities entrusted with the allocation of GHG allowances. The subject of dispute was the calculation method applied to define the maximum annual amount of allowances.

As a consequence, the Cross Sectoral Correction Factor (CSCF) applied to preliminary allocations with Decision 2013/448/EU is not valid and shall be re-calculated on the basis of new data to be provided by the Member States; the maximum annual amount of allowances could be higher or lower than that thus far determined by the Commission.

The Commission is granted 10 months to establish a new amount, whereas the previous allocations of allowances cannot be called into question.
